1. Controller The controller within the meaning of the General Data Protection Regulation (GDPR) is:

There is no obligation to appoint a data protection officer.

2. Purposes and legal basis of processing We process personal data for the purpose of

  • initiating, performing and handling Au Pair placements (Art. 6(1)(b) GDPR),
  • fulfilling legal obligations (e.g. tax retention obligations, visa procedures – Art. 6(1)(c) GDPR),
  • providing and ensuring the technical functionality of our website and web app (legitimate interest, Art. 6(1)(f) GDPR),
  • analysing and improving our services as well as sending newsletters (only with consent, Art. 6(1)(a) GDPR).

3. Collection of personal data We collect data that you provide to us when registering as an Au Pair or host family, via the contact form or in the web app. This includes in particular data required for matching and placement.

In addition, we automatically collect technical data when using the website and web app, such as IP address, browser information and access times (server log files).

4. Recipients and transfer of data Your data will be shared with:

  • Host families and Au Pairs (mutual profile sharing as part of the placement process),
  • Partner agencies worldwide (including in Africa, India, Turkey, Vietnam and other countries),
  • Authorities and embassies (e.g. for visa procedures),
  • Insurance companies (conclusion of insurance policies).

We use the following processors:

  • Hostinger (hosting and MySQL database, servers in the EU),
  • Zoho (email and Workdrive, EU servers),
  • Formidable Forms (form processing within WordPress).

Communication also takes place via WhatsApp where you actively choose this option.

5. Transfer to third countries When transferring data to partner agencies outside the EU/EEA (worldwide), we ensure an adequate level of data protection through EU Standard Contractual Clauses or other appropriate safeguards pursuant to Art. 46 GDPR. An up-to-date list of recipients is available on request by email.

6. Storage period We store your data for as long as it is necessary for the placement and fulfilment of our services.

Due to tax and commercial retention obligations (e.g. accounting), we retain certain data (in particular names of Au Pairs and host families as well as billing-related information) for up to 10 years.

Where no placement exists or has been completed and no statutory retention obligations apply, we will delete or anonymise your profile data upon request. You can request this at any time by email to info@myfamilyaupair.com.

Chat messages in the web app are stored within the periods stated above.

7. Your rights You have the right to access, rectification, erasure, restriction of processing, objection and data portability (Art. 15–21 GDPR). You may withdraw any consent given at any time (with effect for the future).

You may lodge a complaint with the competent supervisory authority (e.g. Bayerisches Landesamt für Datenschutzaufsicht).

8. Cookies and Tracking (CookieYes) We use the cookie consent manager CookieYes to lawfully obtain and manage your consent for the use of cookies and tracking technologies.

Strictly necessary cookies (e.g. for the functionality of the website, forms and web app) are processed on the basis of Art. 6(1)(b) or (f) GDPR.

Cookie Settings

Non-essential cookies (e.g. analytics such as Google Analytics with IP masking, reCAPTCHA, Awin, marketing cookies) are only set with your explicit consent (Art. 6(1)(a) GDPR).

You can set, change or withdraw your preferences at any time via the CookieYes banner. All consents are documented.

9. Web App (Au Pair App) Our web app is used for registration, matching and communication (including chat function and push notifications). All data is stored in our WordPress database. Matching is carried out using internal logic. The chat function is also stored in our database.

10. Payment services (PayPal) When using PayPal, the data required for payment is transferred to PayPal (Europe) S.à.r.l. & Cie. S.C.A. (Art. 6(1)(b) GDPR).

11. Social Media Presences We maintain profiles on Facebook, Instagram, LinkedIn and Pinterest. When visiting these profiles, the respective platform operator processes personal data (e.g. IP address, interactions). We are jointly responsible with Meta Platforms Ireland Ltd. (for Facebook/Instagram) with regard to Page Insights (Art. 26 GDPR, where applicable) and have concluded corresponding agreements.

The purpose is to promote our services and communicate with interested parties (legitimate interest, Art. 6(1)(f) GDPR).

12. Data security Our website is encrypted with HTTPS. The database is hosted by Hostinger in the EU. We take appropriate technical and organisational measures to protect your data.

13. Obligation to provide data Providing the data required for placement is necessary. Without this data we cannot carry out any placement.

14. No automated decision-making There is no exclusively automated matching or profiling.
